No title is transferred by these Terms of Use or by the payment of any fee. Access to ChartScreen must be restricted to users authorized by the ChartScreen subscriber and SRC. You acknowledge that the ChartScreen product in source code remains a confidential trade secret of SRC and therefore you agree not to modify ChartScreen or attempt to decipher, decompile, disassemble or reverse engineer ChartScreen. You further agree not to (i) transfer, assign or sublicense the rights granted to you under these Terms of Use or (ii) sell, distribute or commercially exploit the Application or any associated materials. The charts appearing on ChartScreen were derived from data provided by one or more third party information sources. While these sources are generally reliable, all liability is disclaimed for the accuracy, adequacy or completeness of the charts or other data accessible through ChartScreen. SRC DISCLAIMS ANY AND ALL WARRANTIES, WRITTEN OR ORAL, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. SRC ASSUMES NO RESPONSIBILITY FOR THE USE OF THE APPLICATION, AND SRC SHALL NOT BE LIABLE FOR LOSS OF PROFITS, LOSS OF USE, OR INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES AS A RESULT OF SUCH USE, EVEN IF EXPRESSELY MADE AWARE OF THE POSSIBILITY THEREOF. IN NO EVENT SHALL SRC BE LIABLE FOR MORE THAN THE LICENSE OR SUBSCRIPTION FEE PAID REGARDLESS OF THE TYPE OF CLAIM(S) MADE AGAINST SRC. Adjusted earnings data reflected in the charts appearing on ChartScreen is currently obtained from Thomson Financials 'Baseline' product. Certain data reflected in the charts appearing on ChartScreen may be owned by FT Interactive Data Corporation or its suppliers and is used under license. SRC may immediately terminate your access to ChartScreen if you or another authorized user of the subscriber breaches these Terms of Use or if the subscriber is delinquent in the payment of any subscription or other fees due SRC in connection with the use of ChartScreen.
